Landlords Annual Gas Safety Certificate

Landlords - must ensure that gas fittings are maintained in a safe condition. This means that your gas installations and appliances must be serviced regularly and you must keep records of the services and safety checks. Landlords must have a valid gas safety certificate for all the gas equipment in the accommodation they rent out.

Gas Safety Regulations

Under the Gas Safety (Installation and Use) Regulations 1998 landlords are under a statutory duty to maintain in a safe condition any relevant gas fitting and any flue which serves any relevant gas fitting. This includes items such as gas fires, gas cookers, central heating boilers, water heaters and swimming pool boilers.

Therefore landlords must ensure that gas fittings are maintained in a safe condition. This means that your gas installations and appliances must be serviced regularly and you must keep records of the services and safety checks. You should:

Have a safety check carried out on all gas appliances at least annually. Gas safety certificates are valid for 12 months or until the tenancy changes hands.
Keep a record of each gas safety check for 2 years.
Give a copy of the GAS Safe registered engineer's safety check report to each current tenant, within 28 days of the safety check, or to new tenants before occupation.
Ensure the gas meter and cut-off valve are easily accessible to the tenants and ensure they know how to turn off the gas supply if they suspect a gas or carbon monoxide leak.
Advise your tenants not to use any gas appliance they think is unsafe.

Gas safety checks and any repairs or maintenance or installations must be carried out by a GAS Safe (previously CORGI) registered engineer.

There is no legal requirement for a landlord to install carbon monoxide detectors, but tenants can ask their landlord to provide them.

The Gas Safety Certificate

In order to give a gas safety certificate the engineer has to check:

the gas supply
gas appliances
gas flues
ventilation

The gas engineer has the power to seal off any faulty equipment or request the gas company to cut off the supply to the property.

A gas safety certificate should contain the following information:

the address of the property
the name and GAS Safe (previusly CORGI) number of the gas engineer
a list of all gas appliances in the property and confirmation that they are safe to use. If there is more than one appliance in the property, each individual appliance must be checked and the results of the check must be recorded in a gas safety certificate.
a statement that the flues have been checked and are clear
a list of any remedial action needed

The gas safety regulations are currently enforced by the Health and Safety Executive (HSE). If a landlord does not have a valid gas safety certificate, or does not make repairs required, the HSE has the power to prosecute. Failure to follow gas safety requirements is a criminal offence.

Gas Safety: If you smell gas.....

Do not smoke or light matches
Do not turn electrical switches on or off
Open door and windows
Turn off the meter at the control valve (unless the smell of gas and the meter are in the cellar, as often this will need a light to be turned on)
Call the free 24 hour national gas emergency number 0800 111 999 whether the smell is inside or outside the property.
